Lasting Power of Attorney

It can be distressing to contemplate that we may one day lose the mental capacity to look after our affairs, but sadly it is something that can happen to any of us. If it happens, a member of your family or another person who has your best interests at heart can make an application to the Court of Protection for an order that would enable them to make decisions on your behalf.

This is a lengthy and expensive process, but it can be avoided if you plan for the future while you are mentally capable. You can do this by giving a Lasting Power of Attorney to a person or persons that you trust. This would enable them to make decisions on your behalf if you lose the ability to make such decisions yourself.There are two kinds of Lasting Power of Attorney: one is in respect of property and affairs and the other in respect of personal welfare. You can decide whether you need one or both.

To be effective all Lasting Powers of Attorney must be registered with the Office of the Public Guardian.We have the knowledge and expertise to help you with Lasting Powers of Attorney by drafting the necessary documents and dealing with registration.

Enduring Power of Attorney

It is no longer possible to give an Enduring Power of Attorney, but existing Enduring Powers of Attorneys are still valid.

If the person who gave the Enduring Power of Attorney starts to lose mental capacity the attorney (i.e. the person who has responsibility under the Power of Attorney) should register the Enduring Power of Attorney with the Office of the Public Guardian.

Court of Protection

If a member of your family has lost mental capacity and did not give an Enduring or a Lasting Power of Attorney before losing the ability to make his or her own decisions, it will be necessary to apply to the Court of Protection for an order that would give you the authority to make such decisions.We can help you with Court of Protection applications.
