Executorship, Probate and Administration of Estates

If you have been appointed as an executor under a will or if you are the next of kin of a person who has died without a will and you accept the responsibility of administering the estate, it is your responsibility to account to HMRC in respect of Inheritance Tax, to apply to the High Court for a Grant of Representation, to gather the assets, to discharge the liabilities of the estate and to distribute the estate in accordance with the terms of the will or the intestacy rules.

These responsibilities are onerous as you will be personally liable to creditors and beneficiaries to the extent of all the estate assets received by you.
